General Conditions of Sale

These General Conditions of Sale shall apply to the marketing of the products included in any of the pages of www.easyspanishschool.com (hereinafter, the SITE), together with the Conditions of Use that the USER acknowledges knowing and accepts, which can be consulted at this link.

Contract of sale

The legal and fiscal owner (i.e. the company making the sale) of www.easyspanishschool.com is Easy Spanish School OÜ, Harju maakond, Tallinn, Lasnamäe linnaosa, Lõõtsa tn 5, 11415.

When a USER places an order on the WEBSITE, he/she declares that he/she is of legal age and accepts these General Terms and Conditions of Sale, and this contract is formalised when the USER receives an e-mail from the WEBSITE administrators confirming the order. Once the SITE administrators certify the payment of the amounts corresponding to the products included in the order, the USER will receive another e-mail confirming the purchase.

Methods of payment

Easy Spanish School accepts Visa, MasterCard and American Express credit or debit cards. The USER who chooses this payment option must enter their card details during the purchase process. The SITE only stores the last 4 numbers of the card used for the purchase in order to be able to inform the user in the future of the card used to make the payment. The rest of the data is sent in encrypted form to the STRIPE platform, which manages the payment. In the case of recurring payments, the STRIPE platform is in charge of issuing the payment, guaranteeing with its redundant security systems the security and confidentiality of the data provided by the USER, which do not pass through the SITE again.

The SITE also accepts payments directly through the PayPal.com platform for those persons who have a user on the same. In addition, it will be possible to pay on this same platform without the need to be registered using a Visa, Visa Electron, 4B, Euro6000, MasterCard, American Express or international Maestro cards. The USER who wishes to pay for their order with any of these credit or debit cards must enter their details on the PayPal payment platform, to which they will be redirected at the end of the purchase process. The use of this platform ensures the highest levels of security during the payment process as the data is managed through the secure servers of this company specialising in online payment. The SITE does not collect or store any data from our customers.

USERS related to the cards or PAYPAL account used to pay for orders. In the case of recurring payments, the PAYPAL platform is responsible for creating an “Automatic Payment Profile”, which the USER can manage from their PAYPAL account, guaranteeing with its redundant security systems the security and confidentiality of the data provided by the USER, which does not pass through the WEBSITE again.

In any case, all communications between the page and the USER are secured by means of an SSL security certificate, so that the USER can check at any time that the page visited belongs to the SITE by verifying the URL and the “secure site” symbol placed in front of this URL, which will be of the https type.

Taxes and invoices

According to Estonian tax legislation, Spanish as a foreign language lessons with a teacher are subject to 20% Value Added Tax (VAT), but orders for these products do not include any additional charge, as VAT is included in the total price. However, online courses in which the student works independently and downloadable materials will be affected by the customer’s VAT rate of origin within Europe, a rate which the purchaser will be able to see broken down when making their purchase.

Validity and ownership of class tickets

Tickets for individual lessons and courses offered in the SITE Shop have a 6-month expiry date and can be used at any time by the person who has purchased them. Their transfer or sale to third parties is prohibited, unless expressly authorised in writing by the SITE administrators.

In the event that the purchaser is a company or similar, the tickets or SITE vouchers may be used by several USERS, who must be previously identified by the purchaser by means of an e-mail.

Subscription products

Subscription products sold by the SITE are subject to recurring payment, i.e. with a certain frequency, which will be indicated during the purchase process. These products may only be used by the USER who purchased them, and their transfer or sale to third parties is prohibited. Furthermore, the private areas to which these products give the right to access may only be visited by one IP and device simultaneously, and the SITE reserves the right to automatically expel all but one of the devices or IP addresses.

Refunds

If for any reason the USER is not satisfied with the purchase of courses of more than 10h, the amount paid will be refunded in full within 10 days without any penalty or any other type of cost. The exercise of the right of withdrawal is free, that is to say, no reason must be given and the USER only has to communicate his/her intention to withdraw to the administrators of the SITE (soporte@easyspanishschool.com). For monographic courses of less than 10 hours, the purchase price will not be refunded.

If the USER wishes to cancel the purchase of Spanish classes after having taken any of the classes included in the course, the amount corresponding to the classes not taken will be refunded by the means of the USER’s choice, without any penalty, but at the USER’s expense. The USER must give a reason for requesting cancellation of the purchase so that the WEBSITE can improve the services it offers its USERS.

If the USER cancels a reserved class by notifying at least 24 hours in advance by e-mail to the address soporte@easyspanishschool.com the reservation will be cancelled and the USER will be able to enjoy that class at another time without any extra cost or penalty. If a class is cancelled during the 24 hours prior to the time it was booked or if the USER does not show up at the agreed time, the class will be considered to have been given and the corresponding amount will not be refunded except in exceptional cases and for duly justified reasons.

If the student does not give 24 hours notice or does not show up at the reserved time, the class will be lost. 

In those cases in which the administrators of the WEBSITE unilaterally decide to cancel the classes booked through tickets or vouchers, the USER will be refunded the full amount paid without any penalty or any other type of cost (this unilateral termination of the sales contract by the WEBSITE will always respond to justified causes, generally based on persistent technical problems that make it impossible to give the classes).

Under no circumstances will the amount corresponding to classes booked through tickets or vouchers that have already been received normally by the USER be refunded.

In the case of subscription products, the user also has the right to withdraw from the purchase within the period established by current legislation, with the SITE reserving the right to return only the proportional part of the time not enjoyed, insofar as these products offer the right of access to a private area during the subscription period and it may be understood that this right has been exercised. The exercise of the right of withdrawal is free, i.e. no reason must be given and the USER must only unsubscribe within their USER profile on the same website.

Modification of the General Conditions of Sale

The SITE reserves the right to make changes at any time to the SITE’s website, its policies and its terms and conditions, including these General Terms and Conditions of Sale. The USER shall be subject to the policies, terms and conditions in force at the time he/she places his/her order, unless, by law or requirement of public authorities, changes must be made to them (in which case these changes may apply to any orders placed previously). If any of these conditions should be declared invalid, void or ineffective for any reason whatsoever, that condition shall be deemed excluded without affecting the validity of the rest of the General Conditions of Sale.
